MillerCoors Continues"},"content":{"rendered":"<p><strong>A quick breakdown:<\/strong> San Diego&#8217;s Stone Brewing owns STONE as a trademark for beer, while MillerCoors owns KEYSTONE. In February, Stone <a href=\"http:\/\/www.trademarkyourbeer.com\/stone-vs-millercoors-lawsuit\/\">filed suit<\/a>, claiming that MillerCoors&#8217; recent re-brand of Keystone&#8217;s can and packaging breaks &#8216;KEY&#8217; and &#8216;STONE&#8217; apart, while emphasizing STONE, thus infringing on their mark.<\/p>\n<p>In an 82-page <a href=\"http:\/\/www.trademarkyourbeer.com\/wp-content\/uploads\/2018\/04\/millercoors-answer_11759448-0-20367.pdf\">response<\/a> filed April 10, MillerCoors claims to have used STONE and STONES as nicknames since 1995, about a year before Stone Brewing opened. In that filing, there&#8217;s a &#8220;Hail Mary&#8221; request: MillerCoors should be granted the exclusive right to the mark STONE and STONES in connection with beer sold in the United States.<a href=\"https:\/\/i0.wp.com\/archives.csusm.edu\/westcoastersd\/wp-content\/uploads\/2018\/04\/Screenshot-2018-04-12-at-8.32.04-AM.png?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-20245\" src=\"https:\/\/i0.wp.com\/archives.csusm.edu\/westcoastersd\/wp-content\/uploads\/2018\/04\/Screenshot-2018-04-12-at-8.32.04-AM.png?resize=516%2C568&#038;ssl=1\" alt=\"\" width=\"516\" height=\"568\" srcset=\"https:\/\/i0.wp.com\/archives.csusm.edu\/westcoastersd\/wp-content\/uploads\/2018\/04\/Screenshot-2018-04-12-at-8.32.04-AM.png?w=516&amp;ssl=1 516w, https:\/\/i0.wp.com\/archives.csusm.edu\/westcoastersd\/wp-content\/uploads\/2018\/04\/Screenshot-2018-04-12-at-8.32.04-AM.png?resize=273%2C300&amp;ssl=1 273w\" sizes=\"auto, (max-width: 516px) 100vw, 516px\" \/><\/a><\/p>\n<p>Stone Brewing isn&#8217;t backing down, based on this <a href=\"http:\/\/www.stonebrewing.com\/sites\/default\/files\/stone_brewing_response_041118_final.pdf\">press release<\/a> (also shown as an image above).<\/p>\n<p><strong>Here&#8217;s the rub:<\/strong> MillerCoors claims that following a 2010 cease and desist letter from Stone, no suit was filed for eight years. A &#8220;barred by laches&#8221; defense is offered, meaning Stone had known about the alleged infringement but decided not to act further. The same could be said in response to MillerCoors&#8217; ask for exclusive rights to the marks STONE and STONES; as far as we know, MillerCoors did not file suit against Stone Brewing in Stone&#8217;s twenty-plus year history.<\/p>\n<p><strong>More context:\u00a0<\/strong><\/p>\n<ul>\n<li>Justin Kendall of <a href=\"https:\/\/www.brewbound.com\/news\/millercoors-responds-calls-stone-brewing-trademark-suit-meritless\">Brewbound<\/a>\u00a0wrote a thorough breakdown of MillerCoors&#8217; answer.<\/li>\n<li>Brendan Palfreyman, attorney and creator of TrademarkYourBeer.com, posted <a href=\"https:\/\/twitter.com\/B_Palfreyman\/status\/983990968683819008\">a long Twitter thread<\/a> regarding the April 10 filing.<\/li>\n<li>David Lizerbram, a trademark attorney who wrote an article on <a href=\"https:\/\/www.voiceofsandiego.org\/topics\/economy\/stone-sues-millercoors\/\">Voice of San Diego<\/a> after Stone filed the initial suit, told <em>West Coaster<\/em> that even after reading MillerCoors&#8217; response, he still stuck to his assessment that Stone simply has to demonstrate a likelihood of confusion in the marketplace based on the recent MillerCoors designs.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>A quick breakdown: San Diego&#8217;s Stone Brewing owns STONE as a trademark for beer, while MillerCoors owns KEYSTONE.
